Section 1: General Terms


Acceptance
YOU ACCEPT AND AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT BY SUBSCRIBING, VIEWING, OR USING THE SOFTWARE PRODUCT. YOU MUST AGREE TO THE TERMS OF THIS AGREEMENT BEFORE YOU WILL BE ALLOWED TO USE THE SOFTWARE PRODUCT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, YOU MUST CEASE VIEWING ANY PRODUCTS ASSOCIATED WITH THIS PRODUCT AND DISCONTINUE ANY USE OF THE SOFTWARE PRODUCT.

Restrictions on Transfer
Without first obtaining the express written consent of routefabric, you may not assign your rights and obligations under this Agreement, or redistribute, share, encumber, sell, rent, lease, sublicense, or transfer your rights to the Software Product.

Restrictions on Alteration
You may not modify the Software Product or create any derivative work of the Software Product or its accompanying documentation. Derivative works include, but are not limited to, translations. You may not alter any files that may be downloaded as a result of accessing the Software Product. This Agreement does not permit the sharing or use of routefabric materials in a classroom setting or otherwise.

Disclaimer of Warranties and Limitation of Liability
UNLESS OTHERWISE EXPLICITLY AGREED TO IN WRITING BY ROUTEFABRIC, ROUTE FABRIC MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PURPOSE OTHER THAN AS SET FORTH IN THIS AGREEMENT.

Routefabric makes no warranty that the Software Product will meet your requirements or operate under your specific conditions of use. ROUTE FABRIC makes no warranty that the operation of the Software Product will be secure, error-free, or free from interruption. YOU MUST DETERMROUTE FABRIC WHETHER THE SOFTWARE PRODUCT SUFFICIENTLY MEETS YOUR REQUIREMENTS FOR SECURITY AND UNINTERRUPTABILITY. YOU BEAR SOLE RESPONSIBILITY AND ALL LIABILITY FOR ANY LOSS INCURRED DUE TO FAILURE OF THE SOFTWARE PRODUCT TO MEET YOUR REQUIREMENTS. ROUTE FABRIC WILL NOT, UNDER ANY CIRCUMSTANCES, BE RESPONSIBLE OR LIABLE FOR THE LOSS OF DATA ON ANY COMPUTER OR INFORMATION STORAGE DEVICE.

UNDER NO CIRCUMSTANCES SHALL ROUTE FABRIC, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY OTHER PARTY FOR INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND (INCLUDING LOST REVENUES OR PROFITS OR LOSS OF BUSROUTE FABRICSS) RESULTING FROM THIS AGREEMENT, OR FROM THE FURNISHING, PERFORMANCE, OR USE OF THE SOFTWARE PRODUCT, WHETHER DUE TO A BREACH OF CONTRACT, BREACH OF WARRANTY, OR THE NEGLIGENCE OF ROUTE FABRIC OR ANY OTHER PARTY, EVEN IF ROUTE FABRIC IS ADVISED BEFOREHAND OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT THAT THE APPLICABLE JURISDICTION LIMITS ROUTE FABRIC’S ABILITY TO DISCLAIM ANY IMPLIED WARRANTIES, THIS DISCLAIMER SHALL BE EFFECTIVE TO THE MAXIMUM EXTENT PERMITTED.

Limitation of Remedies and Damages
Your remedy for a breach of this Agreement is the correction or replacement of the Software Product. Selection of whether to correct or replace the Software Product will be at the sole discretion of routefabric. Routefabric reserves the right to substitute a functionally equivalent copy of the Software Product as an update or replacement. If routefabric is unable to provide a replacement or substitute Software Product or corrections to the Software Product, your sole alternate remedy shall be the termination of a concurrent subscription.

Governing Law, Jurisdiction, and Costs
This Agreement is governed by the laws of India, without regard to India’s conflict or choice of law provisions.

Severability
If any provision of this Agreement shall be held to be invalid or unenforceable, the remainder of this Agreement shall remain in full force and effect. To the extent any express or implied restrictions are not permitted by applicable laws, these express or implied restrictions shall remain in force and effect to the maximum extent permitted by such applicable laws.

Member Account Security
If any services require you to open an account, you must complete the registration process by providing us with current, complete, and accurate information as prompted by the applicable registration form. You also must choose a password and a user name. You, the end user, are solely responsible for maintaining the confidentiality of your password and account credentials. Furthermore, you are solely responsible for any and all actions or activities that occur under your account, excluding any breaches of your account that occur within routefabric.

By initiating a routefabric member account, you agree to notify routefabric immediately of any unauthorized use of your account or any other breach of security. Routefabric will not be liable for any loss that you incur due to the use of your password or account by any third party, either with or without your consent. However, you may be held liable for losses incurred by routefabric that result from third party access to your account or password. You may not use anyone else’s account at any time as all member accounts are intended for use by the single intended registrant.

Section 2: End User License Agreement: Subscription and Streaming Products


Each copy of routefabric training materials (“the Software Product”) and accompanying documentation is licensed and not sold. This Software Product – including, but not limited to, All Access Pass or other streaming subscriptions, training bundles, individual course and video downloads, and workbooks – is protected by copyright laws and treaties, as well as laws and treaties related to other forms of intellectual property. Routefabric or its subsidiaries, affiliates, and suppliers (collectively “routefaric”), own intellectual property rights in the Software Product. The Licensee’s (“you” or “your”) license to download, stream, use, or change the Software Product is subject to these rights and to all the terms and conditions of this End User License Agreement (“Agreement”).

License Grant
This Agreement entitles you to view and use the Software Product on one active connection at a time on any compatible device. This Agreement does not permit the downloading of content beyond the standard buffer that video players use in the streaming of content. This Agreement does not permit the use of the Software Product on more than one computer or device at any given time, nor may the materials be accessed by more than one user per login credential (see Member Account Security). Routefabric requires a 1-to-1 license-to-user ratio for all materials.

Section 2.1: Terms of Use: All Access Pass Subscription


By starting your All Access Pass membership, you expressly agree that routefabric is authorized to charge you a membership fee at the current published rate. Your subscription to routefabric’s
-Discounts, rebates, and other special offers only valid for initial term; subscriptions renew at the then-current full subscription rates.
– -Routefabric may terminate the subscription and these Terms if it is unable to renew the subscription based on inaccurate or outdated credit card information.
-Subscription fees are non-refundable.

Section 3: Terms of Use: Download Products
All electronic product purchases and pre-orders, including but not limited to lab workbooks, are final, non-refundable, and non-transferable to any third party unless a prior licensing agreement is documented in writing and approved by routefabric. Electronic accounts suspected of being used by any party other than the purchaser or single intended recipient are subject to revocation without prior notice at the complete and sole discretion of routefabric. Accounts suspended in this manner will not be eligible for refund nor store credit for any used or unused portion of the subscription or materials therein. All electronic products including, but not limited to passwords, dynamic URLs, unique and watermarks, are subject to copy-protection schemes. Any discounts, price modifications, or special deals offered by our sales team associates or website are valid only when purchased directly through www.routefabric.com by the end user and are not valid through any of routefabric’s affiliates, partners, or resellers.

Section 4: Terms of Service: Instructor Led Bootcamps


Bootcamp Cancellation Policy
Refunds for instructor-led bootcamps are not permitted for any reason. If you no longer wish to attend an instructor-led bootcamp you must notify routefabric in writing at least 60 days before the course start date. You are then eligible to receive a store credit that you may apply to another purchase. The store credit extended to you may not be valued at the full cost of your purchase if you received any promotional items or self-paced training materials with your bootcamp purchase. Store credit expires 180 calendar days from issue date and is not transferable.

If for any reason, you need to reschedule a bootcamp, or if you would like to choose your date and location after purchase, you must notify routefabric in writing at least 60 days before the bootcamp start date. At routefabric’s sole discretion, you may incur a rescheduling fee if your request is placed less than 60 days before the original bootcamp start date. Rescheduling fees are based on current bootcamp list price and must be paid before you may attend.
  • Rescheduling 60 days or more in advance will not incur a rescheduling fee.

  • Rescheduling 59-45 days in advance will incur a 5% rescheduling fee.

  • Rescheduling 44-30 days in advance will incur a 15% rescheduling fee.

  • Rescheduling 29 days or less before the class start date will incur a 25% rescheduling fee.


  • Failure to attend your scheduled bootcamp without prior written notification will be considered a “no show” and the full bootcamp price will be forfeited.

    Routefabric reserves the right to cancel or reschedule any bootcamp. Routefabric shall not be liable for lost travel expenses or any other expense incurred by the student related to a rescheduled bootcamp. Routefabric assumes no liability in the case of war (declared or undeclared), natural or man-made disasters, delays or inability to travel, or other forces outside of routefabric’s control through which routefabric determine attending a bootcamp may cause risk to students or routefabric employees. 

    Bootcamp Payment Policies
    Before one can reserve a seat in an upcoming on-site bootcamp, a valid routefabric order must be placed. A valid order consists of an order paid in full using an approved payment method, for which the initial payment has been made on a payment plan, or with receipt of an approved purchase order.
    Any electronic materials included with the bootcamp purchase will be fulfilled to your account upon payment completion, the first payment of a payment plan, or receipt of a valid purchase order.
    Bootcamp orders must be paid in full before the student may attend class.
    Bootcamp must be paid in full before any applicable promotional materials can be ordered or delivered.
    Bootcamp rescheduling fee will apply regardless of the payment method selected. Please refer to the rescheduling policy for further details.
    If a visa invitation letter from routefabric is required to attend your scheduled on-site bootcamp, please plan your payment accordingly. Bootcamp orders must be paid in full before we are able to issue visa invitation letters to students.

    Bootcamp Re-Seat Policy
    The reseat/retake terms in place at the time of purchase will apply to your case. Re-seats are available for bootcamps of the same type, or for bootcamps that have replaced the course you originally attended. You must attend your initial bootcamp before you can register for a re-seat. You may only register for one reseat at a time and must attend the reseat session before scheduling another re-seat. Students may schedule a re-seat for any upcoming bootcamp date, excluding those marked “Sold Out”. Any outstanding fees, including rescheduling fees, must be paid before you can register for a re-seat. You must agree to the reseat terms before you may register.

    Bootcamp students may purchase re-seats at a reduced rate for two years from the date that you attended your original class. At the close of the two-year timeframe, bootcamp students have the option to purchase two more years of discounted re-seats. Re-seat fees are applicable for all tracks. Re-seat fees for bootcamps 6 days or longer are rupees1000 per re-take. For bootcamps of 5 days or less, the cost is rupees500 each time you wish to re-sit. In addition to the reseat fee, if you received a discount on your original purchase, you must pay the difference between list price at the time of purchase and the discounted rate received. If any promotional items (i.e. free travel vouchers, electronic devices, etc.) were included with your bootcamp purchase, you will be required to pay the cost of that item (up to rupees500) in addition to the reseat fee. Requests for reseats after your two-year timeframe will be evaluated on a case by case basis.

    Reseat policy is subject to change at any time at the discretion of routefabric.

    Section 5: Payments, Pricing and Promotions


    Purchase Order Payment Terms
    Billing Dates
    To simplify the billing process and help you plan expenses accordingly, the following payment schedule applies to all orders on a payment plan:
    For orders placed on the 1st through the 14th of a month, your subsequent billing dates will be the 14th of each month. For orders placed on the 15th through the end of the month; your subsequent billing dates will be the 28th of each month. Your initial down payment and your first monthly payment will not be processed during the same calendar month unless otherwise specified. For example, if you place your order on January 17th, your initial payment, plus 5% processing fee, will be charged that day and your next payment will be processed on February 28th. These terms are subject to change at the discretion of our Billing Department.

    Payment Failures and Non-Payment Policy
    If your instalment charge ever fails on your credit card for any reason, you will be contacted by our billing department via email. You will have 5 days from that day to respond to the email and correct the declined payment with our billing team (please ensure “support@RouteFabric.com” is on your email “whitelist”). If, on 5th business day following the failed payment, we have not heard from you nor have arrangements been made to process the payment using another method, your account will go into default and will be suspended from all access to your training materials, including those previously available in your Member Account and not associated with the unpaid order. To reinstate access to your account after it has been suspended, your remaining balance must be paid in full. If your payments have lapsed more than 90 days, a rupees100 reinstatement fee will apply (along with your remaining payment balance) to reactivate access to your account. If your payments have lapsed more than 365 calendar days, your order will be permanently cancelled and all monies paid will be forfeited. Further, your account access will be revoked and will not be eligible for reinstatement. At the discretion of management, routefabric also may report any unpaid order balance to a debt collection agency.

    If your payment plan purchase includes an All Access Pass Subscription and your account access is suspended due to non-payment, you forfeit the subscription time lost while your account was suspended. Any exceptions to the Payment Plan Policy are at the sole discretion of the billing department.

    Price Changes and Refunds
    Product pricing is subject to change without notice. If there is a price drop within 48 hours of your original purchase, you may request a store credit for the price difference, provided your purchase was made at full price. This offer does not apply to any special deals, promotions or discounts you may have already received. This store credit is non-transferable and expires 180 days from the date of the original purchase. All purchases, including pre-orders, are final and non-refundable.

    Store Credit
    Store credits may be issued in a variety of cases. For class cancellation, price change credit, or other exchanging purposes, store credits will be valid for 180 days from the issue date. After 180 days, the credit will be void. Store credits may not be transferred nor converted into a cash refund under any circumstance.

    Promotional Offers
    Promotional offers may occasionally be available with specified purchases. Promotions cannot be combined with any other discounts, promotions or offers unless otherwise stated. The terms and conditions of any promotional offer are set out in the promotional material for such offer, which may vary from our standard terms and conditions, but remain subject to our End User License Agreement. routefabric reserves the right to discontinue promotions at any time. Please ask our sales team for details if you have questions about any promotion.

    Section 6: Equipment Rentals Terms


    Equipment Rentals & Rack Tokens
    Rescheduling of equipment rentals within 45 minutes of the scheduled start time is not permitted and cancellations are ineligible for refunds or store credit, except at the discretion of routefabric. No warranty is given nor liability incurred by routefabric related to the functionality or access to equipment during the said rental period. Credit related to equipment problems may be given at the discretion of routefabric, depending on the nature of the problem.     Rack token purchases are final, non-refundable and non-transferable. Tokens may not be exchanged or used toward the purchase of other products.

    The number of rack tokens required to schedule rack rentals is subject to change without notice.

    Section 7: Content Terms


    Content Updates
    Routefabric Training Bundles – Customers are entitled to product updates only for courses in their original bundle at the time of purchase. Customers are not entitled to receive additional courses which have been added to the bundle after the original purchase date.

    While every effort has been made to ensure that all material in our publications are as complete and accurate as possible, the material is presented on an “as is” basis. Neither the authors nor routefabric assume any liability or responsibility to any person or entity with respect to loss or damages incurred from the information in workbooks or other content.
